Adam & Behrens S.L. receives a commission, which is already included in the purchase price. If there is a commission for the buyer, this is expressly mentioned in the dossier. The offer may only be passed on to third parties with our written consent.
Unauthorized disclosure or direct contact with the owner and the conclusion of a contract resulting from this is legally equivalent to being mediated by our office and is subject to commission.
Adam & Behrens S.L. is entitled to involve other brokers when processing the order.
With the conclusion of the proven or brokered contract, the commission is due and payable. If the debtor is in default of payment, he has to pay default interest in the amount of 5% above the base rate, but at least 6%, unless higher interest can be demanded for another legal reason. If a consumer is not involved, the interest rate is at least 8% above the base rate.
If the amount of the commission has not been agreed, the following commission applies. The amount of the commission is calculated as a percentage from the total economic value of the proven or brokered contracts. In the case of real estate purchase contracts, it amounts to at least 6% plus statutory VAT.
The commission billing is based on the proven or brokered contract. If no contract is presented, the calculation is based on the values of the offer.
If the buyer is already aware of the proven contractual matter, he must inform Adam & Behrens S.L. of this immediately and provide proofe.
The seller is also obliged to inform whether or when and with whom the intended contract came about and which purchase price was achieved. The contract must be submitted immediately after the contract is concluded. Adam & Behrens S.L. is entitled for this purpose to obtain the necessary information from land registry offices, notaries and other parties involved.
Oral side agreements require the written confirmation of Adam & Behrens S.L. to be legally effective.
Viewing appointments can only be made through the office of Adam & Behrens S.L.
Copying files and images from the Adam & Behrens S.L. homepage or from other advertising media of the company is expressly prohibited.
Violations oblige you to pay damages.
The seller is obliged to refer any interested party that contacts him directly - and about who the seller had already been informed by Adam & Behrens S.L. - to Adam & Behrens S.L.
In the case of exclusive contracts, the seller is obliged to refer any interested party, who contacts him directly, to Adam & Behrens S.L.
It is not necessary that the offer price and the closing price match.
The abandonment and nullity of individual conditions does not affect the validity of the remaining stipulations.
General duty to inform according to § 36 VSBG: Adam & Behrens S.L. does not take part in out-of-court dispute settlement procedures before consumer arbitration boards.
The place of fulfilment is Denia. Spanish law applies.
Valid from July 1st, 2018
