Adam & Behrens S.L. strives to process every sale order with the greatest possible care but is only liable if the pages of Adam & Behrens S.L. caused intentional or grossly negligent damage. The statute of limitations is governed by the statutory provisions. If the injured party is a merchant, its claims for damages become statute-barred in three years from their occurrence, but no later than three years after completion of the order.

Subject to error and prior sale. For its mediation Adam & Behrens S.L. charges a commission, which is already included in the purchase price. If a commission is applicable to the buyer, this will be mentioned explicitly in the dossier. The offer may only be passed on to third parties with our written consent.

The unauthorized disclosure or direct contact with the owner and a subsequent contract is legally equivalent to the mediation by our office and is commissionable.

Adam & Behrens S.L. is entitled to engage further brokers when processing the order.

Upon completion of the proven or brokered contract, the commission becomes due and payable. If the debtor is in default of payment, he shall be liable to default interest at the rate of 5% above the base rate, but not less than 6% per annum, unless higher interest rates can be claimed for any other legal reason. If a consumer is not involved, the interest rate is at least 8% above the base rate.

If the amount of the commission is not agreed, then the following commission applies. The amount of the commission is calculated as a percentage of the total economic value of the proven or brokered contracts. It amounts to, in case of property purchase contracts, at least 6% plus VAT.

The commission settlement takes place based on the proven or mediated contract. If no contract is submitted, the calculation is based on the value of the offer.

If the buyer is already aware of the contract matter that has been proven to him, he shall immediately inform and evidence this fact to Adam & Behrens S.L. The seller is furthermore obliged to state whether or when and with whom the intended contract was concluded and what purchase price was achieved. The contract must be submitted immediately after the conclusion of the contract. The Adam & Behrens S.L. is for this purpose entitled to obtain the necessary information from land registry offices, notaries and other parties.

Verbal agreements have to be confirmed in writing by Adam & Behrens S.L. to be legally binding.

Appointments shall exclusively be agreed via the office of Adam & Behrens S.L.

Copying files and images from the homepage of Adam & Behrens S.L. or other advertising material of the company is expressly prohibited. Violations require compensation.

The seller is obliged to refer any prospective customer who approaches him and is already know by him due to the activity of Adam & Behrens S.L. to this entity.

In case of exclusive contracts, the seller is obliged to refer any prospective customer, who approaches him, directly to Adam & Behrens S.L.

It is not necessary to have a concordance between the offer price and the closing price.

The relinquis and nullity of individual conditions does not affect the validity of the remaining agreement.

General information obligation acc. § 36 VSBG: The Adam & Behrens S.L. does not participate in out-of-court dispute settlement proceedings before consumer arbitration boards.

Place of performance is Denia. Spanish law applies.
